E-Verify Employment Eligibility Certification Affidavit

 

  1. I have personal knowledge of the factual assertions set forth herein.
  2. I hereby attest that I am authorized to execute this affidavit on behalf of the above-named Employer, its owners, directors, and officers.
  3. The Employer has contracted with CareerSource Palm Beach County, Inc. (CareerSource) for the provision of On-The-Job Training to CareerSource (the “Agreement”).
  4. Employer warrants and represents that it is in compliance with section 448.095, Florida Statutes, as may be amended, and that it: (1) is registered with the E-Verify system (E-Verify.gov), and beginning January 1, 2021, uses the E-Verify system to electronical[y verify the employment eligibility of all newly hired workers; and (2) has verified that all of Employer’s subcontractors performing the duties and obligations of the Agreement are registered with the E-Verify System, and beginning January 1, 2021, use the E-Verify System to electronically verify the employment eligibility of all newly hired workers.

    Employer shall obtain from each of its subcontractors an affidavit stating that the subcontractors does not employ, contract with, or subcontract with an Unauthorized Alien, as that term is defined in section 448.095(1)(k), Florida Statutes, as may be amended. Employer shall maintain a copy of any such affidavit from a subcontractor for, at a minimum, the duration of the subcontract and any extension thereof. Employer shall provide CareerSource with a copy of said affidavit upon request by CareerSource and shall maintain a copy during the term of the Agreement. This provision shall not supersede any provision of the Agreement which requires a longer retention period.

    CareerSource shall terminate the Agreement if it has a good faith belief that Employer has knowingly violated Section 448.09(1), Florida Statutes, as may be amended. If CareerSource has a good faith belief that Employer’s subcontractors has knowingly violated section 448.09(1), Florida Statutes, as may be amended, CareerSource shall notify Employer to terminate its contract with the subcontractors and Employer shall immediately terminate its contract with the subcontractors. If CareerSource terminates this Agreement pursuant to the above, Employer shall be barred from being awarded a future contract by CareerSource for a period of one (1) year from the date on which this Agreement was terminated. ln the event of such contract termination, Employer shall also be liable for any additional costs incurred by CareerSource as a result of the termination.
